Question about SSA-1099 form & filing Tax. Does my DAUGHTER file a return, or me? She is 14 & my dependant?
My daughter is 14. She has been recieving death benefits from her father's death in 2007. I am filing my taxes. However, on the SSA-1099 it doesn't show MY social security number as the income received, but HERs. My question is, do I file this under MYSELF or do I file a seperate return for her?

busymomkaren:  Most death benefits are not taxable to minors. You do not have to claim it on your taxes and it is not taxable to her unless your daughter has other income that will put her over the thresh hold (very unlikely). If you are unsure, then you can call the Social Security office and they will help you. They are usually pretty good about answering questions. You can also call the IRS and ask them, or look it up on their website at IRS.gov EDIT: This is from the IRS website: 6.3 Social Security Income: Survivors' Benefits Are social security survivor benefits for children considered taxable income? The person who has the legal right to receive the benefits must determine whether the benefits are taxable. For example, if you and your child receive benefits, but the check for your child is made out in your name, you must use only your part of the benefits to see whether any benefits are taxable to you. The amount of income tax that your child must pay on that part of the benefits that belong to your child depends on the total amount of income and benefits for the taxable year. Refer to Publication 915 and Tax Topic 423, Social Security and Equivalent Railroad Retirement Benefits. I would go to Publication 915 (it is online). Basically, what it means is that hers is tax free, but if you get a Survivor's Pension (widow's check), that part may be taxable. Email me if you have more questions.

justdanielle999:  you file her and that is it, you dont have to file the others she is your dependant until she is 18 or still in school i believe dont worry about a thing good luck and go file
