Hi, We own a small consulting firm. We need to issue a 1099-misc to our sales person for commission earned in 2008. Here are my questions: 1. We are planning to send 1099-misc to IRS electronically. What is the due date? 2. Our sales person lives and works in IL. Do we need to send a copy to the state of IL also? if so, can it be sent electronically to the state? and what is the due date? 3) Finally, what is the due date to send recipient's copy? Thanks. Can you please include the address for state of IL where the copy needs to be sent to, if you know? Thanks.

Gem:  The IRS does NOT receive 1099's per se, they get 1096 with supporting 1099s, make sure the correct filing occurs. Your salesman needs his copy NOW, as it was legally supposed to be in the mail by Feb 2, so it is late. In most states the 1099s are never sent to the state, just W2s (usually with your sales, use & withholding annual return). Good luck
