Would like some tax help for a friend?
I have a friend who divorced last year. He told me yesterday that his ex-wife had filed Single and Head of Household for the entire length of their marriage (10 years). She used her parent's address and her father did her taxes every year. Isn't this illegal??? She also understated her income because she is a waitress and had not claimed her cash wages.

dcholsted:  His spouse filed incorrectly. Also, to withhold income from a return is tax evasion and illegal. However, I wonder what return your friend filed. He would have had to file Married Filing Separately if he didn't file with his wife. By doing so he would have included her SSN and name. The IRS would have made the connection by this time. Your friend can turn his spouse in and collect if the IRS charges additional taxes.

Steve:  Technically, it is illegal. However, it would depend on how he filed his tax return to determine if she will get caught or not. If he filed "married filing separately," then he had to include her social security number on his tax return. When she filed her tax returns, this is an error that the IRS would have easily caught. However, if he filed either as "Single" or "Head of Household," then she would not have gotten caught. As far as not claiming her cash wages, such as tips, these will get caught if she gets audited because the IRS will ask her employer to supply them with all receipts that she worked with and estimate her tip income based upon the credit card reciepts.
